Terms of Use
The agreement between you and Offimo when you use the app and this website.
Last updated: October 23, 2026
These Terms of Use (the “Terms”) are an agreement between you and HayatoLab Tecnologia LTDA (CNPJ 48.551.929/0001-35), a company registered in Brazil (“Offimo”, “we”, “us”), the developer of the Offimo app for iPhone (the “App”) and the website offimo.app (together, the “Service”).
By creating an account, starting a trial, buying a subscription or otherwise using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service. Nothing in these Terms takes away rights that the consumer law of your country gives you and that cannot be waived by contract; section 20 lists them by country.
The short version
- Offimo helps you protect your time by blocking or pausing the apps you choose, using Apple’s Screen Time. You stay in control: an Emergency Unlock is always available, in every mode.
- Offimo Premium is an auto-renewing subscription (monthly or yearly) sold by Apple through the App Store, with a 7-day free trial for new subscribers. Cancel at least 24 hours before renewal in your Apple ID settings.
- Refunds are handled by Apple. Deleting the app or your account does not cancel the subscription.
- Focus Credits are earned by protecting your time, cannot be bought or cashed out, and have no money value.
- Offimo is a wellness tool, not medical treatment and not parental control.
- These Terms are governed by Brazilian law, but you keep the protections of the consumer law where you live and can go to your local courts where that law allows it. There is no mandatory arbitration.
1. What Offimo is
Offimo is a digital wellbeing app. You choose apps and websites that pull you away from what matters, and Offimo protects blocks of your day from them: fixed routines (such as morning and night), flexible routines, focus sessions, place-based blocks and pauses before you open a chosen app. Jeff, Offimo’s mascot, reflects how your days are going and nudges you along.
Some features are free and others need Offimo Premium. What each plan includes is shown in the App before you buy, and may change over time as the product evolves. We will not remove a feature you have already paid for in the middle of a billing period without offering a fair alternative or a refund where the law requires it.
We may update, improve, change or discontinue parts of the Service. If we discontinue the App entirely, we will give reasonable notice and stop renewing subscriptions.
2. You always keep control of your phone
Offimo is a consumer app you set up for yourself, not a parental control or employer monitoring tool. Whatever mode or block you choose, the App is designed so that you always have a way out:
- Emergency Unlock is available in every mode (including Hardcore and Financial stake) and every kind of block. It releases everything for 30 minutes. It has deliberate friction (choosing a reason, holding a button, and from the third use in a month a short breathing pause), but it is never unavailable and never costs money.
- Every Shield screen leads back to the App, where you can see why an app is blocked and what your options are.
- You can always turn Screen Time access for Offimo off in iOS Settings, which removes every block.
Offimo cannot block phone calls, emergency calls, or the apps and functions that iOS does not let any third-party app block.
3. Screen Time and how blocking works
Blocking depends on Apple’s Screen Time (FamilyControls, DeviceActivity and ManagedSettings) frameworks, which you authorise when you set up the App. Apple controls how and when these frameworks work, and they can change with iOS updates.
Because of that, we cannot guarantee that every block, schedule, pause or usage figure will always work exactly on time or be exactly accurate. Blocks can be delayed or skipped if, for example, iOS restarts the device, Screen Time permission is revoked, the device is low on storage, or Apple changes the frameworks. Usage figures shown in the App come from Apple and may differ from the Screen Time figures shown in iOS Settings.
Do not rely on Offimo where a failure could put anyone’s health, safety or income at risk.
4. Eligibility and your account
You must be at least 13 years old to use Offimo. If the law where you live sets a higher age to agree to these Terms or to consent to data processing on your own (for example, up to 16 in some European countries, or 18 in Brazil for a binding contract), you may only use Offimo with the permission of a parent or legal guardian, who accepts these Terms on your behalf.
An account is required to use the App. You can sign in with Apple or with an e-mail address and password. You agree to give accurate information, keep your password secret and tell us at support@offimo.app if you think someone else is using your account. You are responsible for what happens in your account unless it was caused by our failure to protect it.
You can delete your account at any time in the App (Settings). Deleting your account removes your account and profile from our servers and wipes the App’s data from your device, as explained in the Privacy Policy. It does not cancel an Apple subscription.
5. Offimo Premium subscriptions and free trial
Plans
Offimo Premium is sold as an auto-renewing subscription, billed monthly or yearly. The App may also show a discounted yearly offer. The price, billing period and what is included are shown on the purchase screen and in the App Store confirmation sheet before you pay, in your local currency and including any taxes Apple collects. Prices vary by country.
Free trial
New subscribers may get a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, the subscription starts and you are charged the price you agreed to at the end of the trial. Each Apple ID can only use the introductory trial once per subscription group. If you buy a subscription during a trial, any unused part of the trial ends.
Automatic renewal
Your subscription renews automatically for the same period at the then-current price, and your Apple ID is charged within 24 hours before the end of each period, unless you turn off auto-renewal at least 24 hours before the end of the current period.
How to cancel
Cancel in iOS Settings → [your name] → Subscriptions → Offimo, or at any time in the App Store. Cancellation takes effect at the end of the current paid period; you keep Premium until then. Deleting the App or your Offimo account does not cancel the subscription.
Payment
Apple is the seller and processes every payment. We never see your card or payment details. Apple’s Media Services Terms and Conditions also apply to your purchase.
Price changes
If we change the price of a subscription, Apple notifies you in advance as its rules and your local law require. Where consent is required, the new price applies only if you accept it; otherwise the subscription ends at the end of the current period.
6. Financial stake level and Focus Credits
Financial stake level
At the Financial stake level you can choose to put a small amount of money on a focus session. Ending that session early costs a one-time in-app purchase whose price is shown before you confirm (for example, R$4.90 in Brazil or US$0.99 in the United States). The fee is paid to Offimo through Apple; it is not donated, invested or held in escrow. Finishing the session is free, and the Emergency Unlock remains free and available during a Financial stake session. You choose the Financial stake level voluntarily and can stop using it at any time.
Focus Credits
Focus Credits are points you earn in the App by protecting your time, for example by completing sessions. You can spend them in the in-app store on items such as a streak Freeze or an extra weekly pass. Focus Credits cannot be bought with money, have no cash value, cannot be sold, transferred or exchanged for money, and are not a currency or payment instrument. We may adjust how many credits things cost or earn, with notice in the App for significant changes. Credits are lost if you delete your account.
Streaks
Streaks, Jeff’s state and other progress indicators are motivational features. They can reset under the rules shown in the App and have no monetary value.
7. Refunds
Because Apple sells and charges every purchase, refunds are decided by Apple under its policies. You can request one at reportaproblem.apple.com or in the App Store under your purchase history. We cannot issue refunds for App Store purchases ourselves, but we will help: write to support@offimo.app.
This does not limit any right to withdraw from a purchase or to a refund that the consumer law of your country gives you (see section 20 and our Refund Policy).
8. Not medical advice
Offimo is a self-help and wellness tool for building healthier digital habits. It is not a medical device and does not provide medical, psychological or therapeutic advice, diagnosis or treatment. Messages from Jeff, reports and suggestions in the App are general encouragement.
If you are worried about compulsive phone use, anxiety, sleep or your mental health, talk to a qualified professional. If you are in crisis, contact your local emergency number.
9. Acceptable use
You agree not to:
- use the Service for anything unlawful, or to monitor or restrict another person’s device without their knowledge and consent;
- copy, modify, reverse engineer, decompile or try to extract the source code of the App, except where the law expressly allows it;
- bypass or tamper with security, subscription checks or purchase validation, or exploit bugs to obtain Premium features, Focus Credits or other benefits;
- access the Service with bots or automated means, or disrupt our servers;
- use the Offimo name, Jeff or our other brand assets in a way that suggests we endorse you, without our written permission.
10. License and intellectual property
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, as allowed by these Terms and by the Usage Rules in Apple’s Media Services Terms and Conditions (the App may also be used by other accounts in your Family Sharing group where enabled).
The App, the website, Jeff and all of their designs, text, illustrations, sounds, software and trademarks belong to HayatoLab Tecnologia LTDA or its licensors and are protected by intellectual property laws. These Terms do not give you any ownership of them.
Content you create in the App (such as block names, notes or photos you take for a challenge) stays yours. Those items are stored on your device; we only process the account details described in the Privacy Policy.
If you send us feedback or suggestions, we may use them freely without owing you anything.
If you believe something in the Service infringes your copyright, write to support@offimo.app with the work concerned, where it appears, your contact details and a statement that you are the owner or authorised to act for them.
11. Third-party services
The Service relies on Apple (App Store, payments, Sign in with Apple, Screen Time) and on the service providers listed in the Privacy Policy. Their own terms apply to your use of their services, and we are not responsible for services we do not control. Links to other websites are provided for convenience only.
12. Terms specific to the Apple App Store
The following applies because you obtained the App from the Apple App Store:
- These Terms are between you and Offimo only, not Apple. Offimo, not Apple, is solely responsible for the App and its content.
- Your license is limited to using the App on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the App. Support questions go to support@offimo.app.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Offimo’s responsibility, to the extent they cannot be disclaimed.
- Offimo, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the App or your possession and use of it infringes their intellectual property rights, Offimo, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right to enforce them against you as a third-party beneficiary.
13. Warranties
We work hard to make Offimo reliable and we will fix defects we become aware of within a reasonable time. Beyond that, and to the extent the law of your country allows, the Service is provided “as is” and “as available”, and we do not promise that it will be uninterrupted, error-free, or that it will produce any particular result for your habits or wellbeing.
Nothing in this section excludes the legal guarantees that consumer law gives you and that cannot be excluded by contract, such as the guarantee of conformity for digital content in the European Union, the statutory rights under the UK Consumer Rights Act 2015, or the warranties of the Brazilian Consumer Defence Code.
14. Limitation of liability
To the extent permitted by the law that applies to you, Offimo is not liable for indirect or consequential losses, such as lost profits, lost opportunities or loss of data, and our total liability for any claim related to the Service is limited to the amount you paid for the Service in the 12 months before the claim (or R$100 / US$20 if you paid nothing).
These limits do not apply to liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, for fraud or wilful misconduct, or for defects under consumer protection laws that do not allow such limits.
15. Suspension and termination
You can stop using the Service at any time, and delete your account in the App.
We may suspend or close an account that seriously or repeatedly breaches these Terms, commits fraud, or puts the Service or other people at risk. Except in urgent cases or where the law prevents it, we will tell you why and give you a chance to respond first. If we close your account without a valid reason, you are entitled to a proportional refund of any prepaid subscription period, to be handled with Apple.
Sections that by their nature should continue (such as intellectual property, liability and governing law) survive termination.
16. Changes to these Terms
We may update these Terms when the Service or the law changes. The date at the top shows the latest version. For material changes that affect your rights, we will notify you in the App or by e-mail at least 15 days before they take effect, unless a change is needed sooner for legal or security reasons. If you do not agree, you can stop using the Service and cancel your subscription before the change takes effect; continuing to use the Service after that means you accept the new Terms.
17. Governing law and disputes
These Terms are governed by the laws of the Federative Republic of Brazil. If you are a consumer living in another country, you also keep the protection of the mandatory provisions of the consumer law of your country of residence, and you may bring a claim in the courts of the place where you live if that law gives you that right.
There is no mandatory arbitration and no waiver of class or collective actions in these Terms. Before going to court, please contact support@offimo.app: most problems can be solved quickly by e-mail, and we will reply within 10 business days.
18. General
- Entire agreement: these Terms, the Privacy Policy and the terms shown at the time of a purchase are the whole agreement between you and us about the Service.
- Severability: if a court finds part of these Terms invalid, the rest stays in effect.
- No waiver: if we do not enforce a right right away, we do not give it up.
- Transfer: we may transfer these Terms to a company that takes over the Service, provided your rights are not reduced. You may not transfer your account.
- Force majeure: we are not responsible for delays or failures caused by events outside our reasonable control, such as outages at Apple or our providers, natural disasters or government action.
- Languages: these Terms are available in several languages. They are drafted in Portuguese and English; if versions conflict, the Portuguese version prevails for users in Brazil and the English version elsewhere, unless your local law requires the version in your language to prevail.

20. Consumer rights by country
Offimo is sold in App Store storefronts around the world. The rules above apply everywhere, subject to the local consumer rights below. If your country is not listed, you still have every right that your local law guarantees.
Brazil
- The Consumer Defence Code (Law 8,078/1990, “CDC”) applies to your relationship with Offimo, and any clause of these Terms that conflicts with it has no effect.
- Right of withdrawal: for purchases made outside a physical store, you may withdraw within 7 days of the purchase or of the start of the paid subscription (CDC art. 49), with a full refund. Request it at reportaproblem.apple.com or write to support@offimo.app and we will help you get it processed with Apple.
- The free trial already lets you try Premium without paying; if you do not cancel, your 7-day withdrawal period starts on the first charge.
- You may bring a claim in the courts of your own domicile (CDC art. 101). You can also file a complaint at consumidor.gov.br or with your local PROCON.
- Prices are shown in reais, with taxes included by Apple.
European Union and EEA
- Right of withdrawal: under Directive 2011/83/EU you normally have 14 days to withdraw from a contract for digital content or services. When you start a paid subscription in the App Store, you ask for the service to start immediately and acknowledge that, where the Directive allows it, you lose the right of withdrawal once the service has been fully performed or, for digital content, once supply has begun. For subscriptions, you may still withdraw within 14 days, and you may be charged only for the portion of the period already provided. Refunds are requested from Apple at reportaproblem.apple.com.
- Legal guarantee of conformity: under Directive (EU) 2019/770 you are entitled to digital content and services that conform to the contract for the whole subscription period. If they do not, you can ask for the defect to be fixed, or for a price reduction or termination with a refund.
- Your courts: you may bring a claim in the courts of the EU country where you live, and the mandatory consumer law of that country applies.
- Out-of-court help: your national consumer authority or the European Consumer Centres Network (eccnet.eu) can help with cross-border disputes.
United Kingdom
- Cancellation: under the Consumer Contracts Regulations 2013 you may cancel within 14 days of purchase. By starting a subscription you agree to immediate supply of digital content, which means the right to cancel may be lost once supply has begun; request refunds from Apple at reportaproblem.apple.com.
- Statutory rights: under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. If it is faulty, you are entitled to a repair or replacement, or in some cases a price reduction or refund. Nothing in these Terms affects these rights.
- You may bring a claim in the courts of England and Wales, Scotland or Northern Ireland, depending on where you live. Citizens Advice (citizensadvice.org.uk) can give free advice.
United States
- Automatic renewal: before you subscribe, the App and Apple show the price, billing period, that the subscription renews automatically until cancelled, and how to cancel. You can cancel online at any time in your Apple ID settings, as required by state automatic renewal laws (including California Business and Professions Code § 17600 and following).
- No arbitration: these Terms contain no arbitration agreement and no class action waiver.
- California residents: under California Civil Code § 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
- New Jersey residents: the limitations in sections 13 and 14 apply only to the extent permitted by New Jersey law.
- Some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so some of the limits above may not apply to you.
Canada
- Your provincial consumer protection law applies in addition to these Terms, including any right to cancel and any rule on renewals of distance contracts.
- Québec residents: clauses in sections 13, 14 and 17 that exclude or limit liability or impose a forum do not apply to you to the extent they are incompatible with the Consumer Protection Act (CQLR c P-40.1). You may contact the Office de la protection du consommateur (opc.gouv.qc.ca).
Mexico
- The Federal Consumer Protection Law (Ley Federal de Protección al Consumidor) applies. Prices are shown in Mexican pesos with taxes included.
- You may cancel the subscription at any time in your Apple ID settings, by the same means you used to subscribe.
- You may file a complaint with PROFECO (gob.mx/profeco) and bring a claim before the competent authorities in Mexico.
Japan
- Digital content purchased through the App Store is sold by Apple, and the information required by the Act on Specified Commercial Transactions for those sales is provided by Apple. For questions about Offimo itself, contact support@offimo.app.
- Under the Consumer Contract Act, any clause in these Terms that fully exempts Offimo from liability for damages caused by our wilful misconduct or gross negligence, or that unilaterally harms your interests against the principle of good faith, has no effect.
- You may seek advice from your local consumer affairs centre (消費生活センター) by calling 188.
India
- The Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 apply. Prices are shown in rupees with taxes included by Apple.
- Grievance officer: complaints can be sent to support@offimo.app. We acknowledge them within 48 hours and resolve them within one month.
- You can also contact the National Consumer Helpline (consumerhelpline.gov.in, 1915) and bring a claim before the consumer commission where you live.
Other countries
If you live in any other country, these Terms apply together with the mandatory consumer protection rules of your country, and any clause that conflicts with those rules does not apply to you. Contact support@offimo.app and we will tell you how to exercise your local rights.
